These Terms constitute a legally binding agreement between you (and, where applicable, your employer) and BaikalSphere. Your continued use of our platform and mobile application constitutes ongoing acceptance of these Terms, including any updates we make in the future.

BaikalSphere provides an enterprise HR and workforce management platform, including features for employee scheduling, attendance tracking, leave management, payroll reporting, and related operational tools. Services are offered via our web platform and mobile applications available on the Apple App Store and Google Play.

To access our services, you must:

• Be at least 16 years of age and authorised by your employer to use the platform.
• Provide accurate, current, and complete information during registration.
• Keep your login credentials confidential and not share your account with others.
• Notify us immediately at support@baikalsphere.com if you suspect unauthorised access to your account.

You are responsible for all activity that occurs under your account. BaikalSphere is not liable for any loss or damage arising from unauthorised use of your credentials where such use results from your failure to keep them secure.

You agree to use our services only for lawful purposes. You must not:

• Use the platform to harass, harm, or discriminate against any individual.
• Attempt to gain unauthorised access to any part of the system, servers, or networks.
• Upload, transmit, or distribute malware, viruses, or any malicious code.
• Reverse-engineer, decompile, or disassemble any part of the software.
• Scrape, mine, or extract data in an automated manner without prior written consent.
• Use the services in a way that could damage, disable, or impair platform availability.
• Misrepresent your identity, qualifications, or employment status.

We reserve the right to suspend or terminate your access immediately if we reasonably believe you have violated these acceptable use provisions.

If you are accessing BaikalSphere as an organisation (employer), you acknowledge that you are responsible for ensuring your employees are informed about the use of this platform and any applicable data processing, in accordance with relevant employment and data protection laws. Administrators must use their elevated access privileges solely for authorised HR management purposes.

All content, features, functionality, trademarks, logos, and software on the BaikalSphere platform are the exclusive property of BaikalSphere or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the services solely for your authorised internal HR management purposes.

Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, or create derivative works based on our platform or content without our prior written consent.

Our platform may integrate with or link to third-party services (e.g., payroll providers, identity providers). These third-party services are governed by their own terms and privacy policies. BaikalSphere is not responsible for the content, practices, or availability of any third-party service.

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by applicable law, BaikalSphere and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunities — arising out of or in connection with your use of, or inability to use, our services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising under these Terms shall not exceed the amount you (or your employer) paid to us in the twelve (12) months preceding the event giving rise to the claim.

You or your employer may terminate your account at any time by contacting us. We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or where required by law. Upon termination, your right to access the platform ceases immediately. Data retention following termination is governed by our Privacy Policy.

We may update these Terms from time to time to reflect changes in our services or applicable law. When we do, we will update the effective date at the top of this page and, for material changes, notify you via email or an in-app notice at least 14 days before the changes take effect. Continued use of our services after the updated Terms take effect constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of India, specifically the jurisdiction of Rajasthan. BAIKALSPHERE AI AUTOMATION PRIVATE LIMITED is incorporated in India and operates under applicable Indian corporate and information technology laws. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Udaipur, Rajasthan, India.
